Terms of Use

These terms of use set out how you may use our iOS applications including Footystats. By downloading, installing, using the app you agree to these terms. If you do not agree, do not use the app.

1. app provider

The app is provided by airMY Pty Ltd. References to we, us, our are to this company.

2. eligibility

You must be able to enter into a binding agreement under Australian law to use the app. If you are using the app for a club or team you confirm you are authorised to do so.

3. licence

We grant you a limited, non exclusive, non transferable licence to install and use the app on Apple devices you own or control, in line with the App Store terms, these terms of use.

4. subscriptions

Some features such as BballStat Pro require an auto renewing subscription purchased through Apple.

• payment is charged to your Apple ID account at confirmation of purchase
• subscriptions renew unless cancelled at least 24 hours before the end of the current period
• you can manage or cancel your subscription in App Store account settings
• if you cancel you can keep using the features until the end of the current period

5. data, backups, iCloud

Match data is primarily stored on your device. If you enable or purchase Pro the app may use iCloud to sync data. You are responsible for managing your own device backups. We are not liable for loss of data caused by device failure, user deletion, disabled iCloud sync, network issues.

6. acceptable use

You must not

• reverse engineer, decompile, modify the app except where allowed by law
• use the app for unlawful, defamatory, infringing purposes
• circumvent subscription or licensing features

7. intellectual property

All rights in the app, code, designs, logos, text are owned by airMY Pty Ltd or our licensors. Using the app does not transfer any ownership.

8. accuracy of stats

The app is designed to make it easier to record live sports statistics, including basketball and Australian rules football, but recorded stats still depend on human input and judgement. We do not warrant that recorded data is complete, free from error, or suitable for professional analysis. Use the stats as a guide only and always cross check with official scores or records where accuracy is critical.

9. liability

To the maximum extent permitted by law we exclude all conditions, warranties, guarantees not expressly set out in these terms. Where the Australian Consumer Law (ACL) applies our liability is limited to supplying the service again or paying the cost of having the service supplied again.

10. termination

We may suspend or terminate your access if you breach these terms or misuse the app. You may stop using the app at any time by deleting it from your device.

11. changes

We may update the app or these terms from time to time. If you continue to use the app after changes take effect you are taken to have accepted the changes.
